These Terms & Services ("Terms") govern your access to and use of the website myislandbroker.com (the "Site") and related informational services offered by My Island Broker ("we," "us," or "our"). By browsing the Site, submitting a form, or subscribing to communications, you agree to these Terms. If you do not agree, please discontinue use of the Site.

1. Nature of Our Services

My Island Broker provides educational content, project planning resources, and introductions to independent home improvement professionals. Unless a separate written agreement states otherwise, we are not the general contractor of record for construction work performed at your property. Licensed trades and remodeling companies you engage remain solely responsible for their labor, materials, warranties, and compliance with applicable building codes.

Descriptions of services, pricing ranges, and timelines on the Site are illustrative and may change without notice. A binding scope of work arises only when you execute a written contract directly with a service provider or with us under a signed project agreement.

2. Eligibility and Accounts

You must be at least eighteen years old and able to form a binding contract to use our inquiry forms or subscription features. You agree to provide accurate, current information and to update it when circumstances change. You are responsible for maintaining the confidentiality of any credentials associated with future account features and for all activities conducted under your identity.

3. Permitted Use

You may use the Site for lawful personal or business purposes related to researching and planning residential improvements. You may not scrape, reverse engineer, or interfere with Site security; upload malicious code; impersonate others; harvest email addresses; or use automated systems that impose unreasonable load on our infrastructure. We may suspend access that violates these rules or threatens the experience of other users.

4. Estimates, Pricing, and Third-Party Services

Online calculators, package pricing, and blog content are planning tools only. Field conditions—such as hidden water damage, outdated wiring, or structural modifications—can materially affect cost and schedule. Independent contractors may perform their own measurements and propose change orders when unforeseen conditions appear.

We do not guarantee the lowest price in any market. We do strive to promote transparent proposals that separate labor, materials, allowances, permits, and contingency lines so you can compare options intelligently.

5. Contractor Relationships

When we introduce you to a partner, that introduction does not create a partnership, joint venture, or employment relationship between My Island Broker and the contractor. Contractors maintain their own insurance, licensing, safety programs, and workmanship policies. You should verify credentials and read contracts carefully before authorizing work.

We may receive fees from partners for qualified referrals or coordination services. Where required, we disclose material connections in project documentation. Referral compensation does not relieve contractors of their obligations to you.

6. Intellectual Property

The Site, including text, graphics, logos, page layouts, and software, is owned by My Island Broker or our licensors and protected by copyright and trademark laws. You may view and print reasonable copies for personal planning purposes. You may not reproduce, distribute, modify, or create derivative works for commercial publication without prior written consent.

Project photographs displayed with permission remain the property of their respective creators. Testimonials reflect individual experiences and are not a guarantee of future results.

7. User Submissions

When you submit inquiries, photos, measurements, or feedback, you grant us a non-exclusive license to use that content to respond to your request, improve our services, and create anonymized analytics. Do not submit sensitive personal data unrelated to home improvement. You represent that you have rights to any images or documents you upload and that they do not infringe third-party rights.

8. Communications and Marketing

By subscribing to newsletters or checking consent boxes on forms, you authorize us to send email messages about guides, promotions, and service updates. You may withdraw consent at any time using the unsubscribe page or links within messages. Transactional communications related to an active project inquiry may continue until that matter is closed.

9. Disclaimers

THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

Construction involves inherent risks. Always follow manufacturer instructions, obtain required permits, and consult qualified professionals for structural, electrical, plumbing, and environmental questions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY ISLAND BROKER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY CONSTRUCTION SERVICES PERFORMED BY THIRD PARTIES.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS OR (B) THE AMOUNTS YOU PAID DIRECTLY TO US FOR COORDINATION SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless My Island Broker from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, infringement of third-party rights, or disputes with contractors except to the extent caused by our gross negligence or willful misconduct.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which My Island Broker is organized, without regard to conflict-of-law principles. Parties will attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration on an individual basis, except that either party may seek injunctive relief in court for intellectual property misuse or unauthorized access.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION AGAINST MY ISLAND BROKER.

13. Changes to These Terms

We may update these Terms to reflect new features, regulatory requirements, or business practices. The "Last updated" date at the top will change when revisions are posted. Continued use after changes constitutes acceptance. Material changes may also be highlighted on the Site or via email when appropriate.

14. Severability and Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any signed project agreement, constitute the entire agreement regarding Site use.
